Administration of Justice Act 1970

This act is to stop creditors or their collection agents making demands which cause distress.

The Protection from Harassment Act 1997

This act is for when the creditor or collection agents make repeated calls (this can be verbal or in letter form) to your place of work or in anti social hours at your home.

The Office of Fair Trading

There are guidelines set by the OFT (Office of Fair Trading) for Debt Collection and Debt Management. The main part is that the creditor or its agent must not contact debtors at unreasonable times and intervals. They do offer examples as calling repeatedly, knocking at neighbour’s doors and discussing that a debt is outstanding, calling at work and at unsociable hours. If you feel a creditor or agency has broken these guidelines the OFT recommend you speak to the creditor/agency first. Then explain how you would prefer to be contacted. If they do not adhere to your request then further advice is available from the OFT or the Citizens Advice Bureau.
